1) We assert that Cindy Sheehan and her associates have a Constitutional right, guaranteed under the First and Fourteenth Amendments of the United States Constitution, to assemble peaceably and petition their Government for redress of their grievances, whatever those grievances may be.

Here is the text of the First Amendment:

First Amendment

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

Here is the text of the Fourteenth Amendment, Section 1:

Fourteenth Amendment, section1

"All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

2) Moreover, we assert that these rights of assembly and petition, guaranteed by these two Constitutional amendments, have higher legal authority than any laws or regulations issued under the authority of federal, state, or local governments, according to Article 6 paragraph 2 of the Constitution, as shown below:

Article 6 paragraph 2

"This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any state to the Contrary notwithstanding."

3) Moreover, we assert that these rights of assembly and petition apply to any branch or agency of Government, in any location whatsoever; in particular, to the President of The United States, near his ranch in Crawford, Texas.

4) Moreover, we assert that the particular grievances of Cindy Sheehan and her associates are of the very highest level of importance, perhaps higher in importance than any other grievances ever previously petitioned, since they pertain to grave matters of life and death for thousands, even millions, of people. Therefore any restrictions or limitations on these rights, which may have ever been upheld by our Courts in previous cases, should not apply to this case, because of its extreme importance. In particular, any restrictions based on mere administrative convenience, or for any reason other than the most compelling Public necessity, should not apply to this case; certainly a property owner's normal limited right to prohibit trespassing does not outweigh these Constitutional rights to assembly and petition, in this case.
